1) Scope of Application
1.1 These Terms and Conditions ("T&Cs") of KOKO WAX LTD ("Seller") apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur ("Customer") with the Seller via the online store.

1.2 A consumer is any natural person entering into a legal transaction for purposes that are not primarily related to their trade or independent professional activity.

1.3 An entrepreneur is a natural or legal person, or a partnership with legal capacity, acting in the course of their trade or independent professional activity.


2) Conclusion of Contract
2.1 Product descriptions in the online store do not constitute binding offers but invite customers to make a binding offer.

2.2 The customer can submit the offer via the online order form integrated into the Seller's shop. After placing items in the virtual cart and going through the order process, clicking the final button constitutes a legally binding offer.

2.3 The Seller may accept the customer's offer within five days:

  • by sending a written order confirmation, or

  • by delivering the ordered goods, or

  • by requesting payment from the customer.

The contract is concluded at the time one of these events occurs first.

2.4 The contract text is stored and sent to the customer via email after order submission. Additional access is not provided.

2.5 Before submitting the order, customers can detect input errors by carefully reviewing the on-screen information and correct them using standard keyboard and mouse functions.

2.6 The contract language options are indicated in the shop.

2.7 Order processing and communication typically occur via email. Customers must ensure the accuracy of their provided email address.


3) Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.

3.2 Further details are provided in the Seller's cancellation policy.

3.3 The right of withdrawal does not apply to consumers whose sole residence and delivery address are outside the EU at the time of contract conclusion.


4) Prices and Payment Terms
4.1 Prices include VAT unless stated otherwise. Shipping costs are shown separately.

4.2 Additional charges (e.g., bank fees, customs duties) may apply for non-EU deliveries.

4.3 Payment options are shown in the online shop.

4.4 For payments via Stripe, Stripe Payments Europe Ltd. handles the transaction. More info at https://stripe.com

4.5 For credit card payments via Stripe, the amount is due immediately.

4.6 Payments via Klarna are processed through Klarna Bank AB. Terms are shown during checkout.


5) Delivery and Shipping Conditions
5.1 Orders are delivered within 5–12 business days to the address provided unless otherwise agreed.

5.2 If delivery fails due to customer fault, they must bear the related costs.

5.3 Risk passes to business customers upon handover to the shipping company. For consumers, risk passes upon delivery, unless they choose the shipping provider independently.

5.4 The Seller reserves the right to cancel in case of non-supply or incorrect supply from suppliers.

5.5 Self-collection is not available.


6) Retention of Title
Until full payment, the delivered goods remain the property of the Seller.


7) Liability for Defects (Warranty)
7.1 For entrepreneurs:

  • Seller chooses the type of remedy.

  • Warranty for new items: 1 year.

  • No warranty for used items.

  • Replacement does not restart the limitation period.

7.2 Limitations do not apply to:

  • Customer damage or expense claims

  • Fraudulently concealed defects

  • Items for construction use that caused defects

  • Legal update obligations for digital elements

7.3 Statutory recourse rights for entrepreneurs remain unaffected.

7.4 Commercial customers must report defects per § 377 HGB or forfeit warranty.

7.5 Consumers should report transport damages, but this does not affect rights.


8) Redemption of Promotional Vouchers
8.1 Promo vouchers are free, time-limited, and non-purchasable.

8.2 Some items may be excluded from promotions.

8.3 Vouchers must be redeemed before order completion.

8.4 Only one voucher per order.

8.5 Order value must match or exceed the voucher amount. No refund of remaining balance.

8.6 Shortfalls can be paid with other payment methods.

8.7 No cash payout or interest on vouchers.

8.8 No refund of voucher value if goods are returned.

8.9 Vouchers are transferable unless used fraudulently.


9) Applicable Law
9.1 German law applies, excluding UN sales law. Consumer protections of their country of residence remain unaffected.

9.2 This choice of law does not apply to non-EU consumers at time of contract.


10) Jurisdiction
10.1 German courts have jurisdiction for commercial customers.

10.2 For foreign commercial customers, jurisdiction is at the Seller's business location.


11) Alternative Dispute Resolution
11.1 The EU Commission offers a platform for online dispute resolution at: https://ec.europa.eu/consumers/odr

11.2 The Seller is neither obligated nor willing to participate in dispute resolution before a consumer arbitration board.
